The Licensing (NI) Order 1996 (Article 22, Schedule 5, (Paragraphs 1 and 2) Notice of Application for the Transfer of a Licence Petty Sessions District of
Fermanagh County Court Division of Fermanagh and Tyrone
TAKE NOTICE that I Bryan Thompson of 41 Dromard Road, Drumhoney, Kesh, Co. Fermanagh, BT93 1RY intend at the Magistrate's Court sitting at the Court House, East Bridge Street, Enniskillen, Co. Fermanagh on the 6th day of June 2016 at 10.00am to apply for the transfer to me of a Licence at present held by Mungo Sloan of 24 Coolnagard Heights, Omagh, Co. Tyrone for the Licensed Restaurant and Premises known as Drumrush Lodge, Boa Island Road, Kesh, Co. Fermanagh being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article: 5(1) (e) a Restaurant.
A Protection Order authorising me to carry on the business under the Licence was granted on the4th dayofApril 2016bythe Magistrate's Court sitting at The Courthouse, East Bridge Street, Enniskillen, Co. Fermanagh for the period of six months from the date of the Order.
I am the owner of the business to be carried on under the Licence.
The owner of the premises is Northern View Leisure Limited having its registered office at 18 Dungannon Road, Cookstown, Co. Tyrone.
The Licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the Application.
FURTHER TAKE NOTICE that
any person owning, residing or carrying on business in premises in the vicinity of the premises for which the transfer of the Licence is sought must, in accordance with Paragraph 4, Schedule 5 to the said Order serve notice of his or her intention to object upon the Applicant and the Clerk of Petty Sessions not less than one week before the opening of the Court sitting. The permissible grounds for objection are as specified in Article 22 (6) of the said Order, namely: (a) the proper procedure has not been complied with, (b) the Applicant is not a fit person to hold a Licence, (c) the business carried on in the premises under the Licence and the business to which the sale of intoxicating Liquor under the Licence is ancillary has been discontinued.
