NOTICE OF APPLICATION FOR THE TRANSFER OF
A LICENCE
Petty Sessions District of Fermanagh County Court Division of Fermanagh and Tyrone
TAKE NOTICE that we, Musgrave Retail Partners NI Limited, having its registered office address at Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG intends to apply to the Magistrate's Court sitting at Enniskillen Court House, East Bridge Street, Enniskillen, BT74 7BW on Wednesday 16th day of November 2016 at 10.00am to apply for the transfer of a licence at present held by McBrien Supermarket Limited whose registered office address is 6 Ardlougher Road, Irvinestown, Co. Fermanagh BT94 1RN to Musgrave Retail Partners NI Limited for the premises at Milltate, Link Road, Irvinestown, BT94 1DW being premises of the following kind as mentioned in Articles 5(1) and 80(1) of the Licensing (Northern Ireland) Order 1996 namely:
that we, Musgrave Retail Partners NI Limited, having its registered office address at Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG intends to apply to the Magistrate's Court sitting at
East Bridge Street, Enniskillen, BT74 7BW on
to apply for the transfer of a licence at present held by McBrien Supermarket Limited whose registered office address is 6 Ardlougher Road, Irvinestown, Co. Fermanagh BT94 1RN to Musgrave Retail Partners NI Limited for the premises at Milltate, Link Road, Irvinestown, BT94 1DW being premises of the following kind as mentioned in Articles 5(1) and 80(1) of the Licensing (Northern Ireland) Order 1996 namely:
5(1)(b) - premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption offthe premises.
A Protection Order authorising Musgrave Retail Partners NI Limited, having its registered office address at Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG to carry on the business under the licence was granted on the 28th day of September 2016 by the Magistrate's Court sitting at Enniskillen Court House, East Bridge Street, Enniskillen, BT74 7BW for the period until 28th March 2017.
The following body corporate owns the business carried on under the licence:

The owner ofthe premises is Musgrave Retail Partners NI Limited having its registered office address at Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG.
The licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the application.
Any person referred to in paragraph 3 of Schedule5(Part1)of theLicensing (Northern Ireland) Order 1996, who intends to object to the transfer of the licence must, in accordance with paragraph 4 of Schedule 5 (Part1)of the Licensing (Northern Ireland) Order 1996, serve notice of his intention to object and briefly state the grounds for objection, upon the applicantat its solicitor's address at Arthur Cox, Victoria House, Gloucester Street, Belfast, BT1 4LS, and upon the clerk of petty session of thecourt to which this application applies, not less than one week before thet ime of the opening of thecourt sitting at which the application is to be made. The notice of intention to object must be in the prescribed form of notice which is Form 5 of the Magistrates Court (Licensing) Rules (Northern Ireland) 1997. Thepermissible grounds of objection are specified Article 22(6) of the Licensing (Northern Ireland) Order 1996.
