ENNISKILLEN Magistrates Court heard on Monday how a 51-year-old man told police he would murder his girlfriend, and spat at a police officer.
Boguslaw Cwierz, of Monaghan Road, Rosslea, appeared at Enniskillen Magistrates Court via video link from Maghaberry Prison to face charges of assault on police and threats to kill.
Police responding to a domestic incident involving the defendant arrested him, and took him into custody.
On December 5, 2020, while Cwierz was waiting outside the custody bay, he spat towards a police officer who had to duck to avoid being hit. The defendant was arrested for assault on police.
Later, when asked questions about self harm, the 51-year-old said if he went home “I will murder my girlfriend”.
Other responses included that he wanted to go to the shop and drink vodka, that he would seek his revenge, and “I will drink alcohol and kill her anyway”.
When he was interviewed, the defendant said he never meant to hurt his girlfriend, and that he was generally a peaceful person who maybe needed mental support because he may be crazy.
He added that he did not spit at the officer on purpose, and had something in his mouth.
Cwierz had been remanded in custody since the incident in December.
Michael Fahy, Cwierz’s solicitor, told the court there was never any witness statement made about the domestic incident, and if his client had behaved himself, he would not be before the court, and that he could have been facing an alternative sentence rather than imprisonment for the charges.
He pointed out that his client had spent the equivalent of seven months in prison, and asked the court to factor that in when sentencing.
District Judge Steven Keown handed down a six-month sentence, with time already served by Cwierz.
