A MAN has been convicted of driving with excess alcohol in his blood after he was stopped by police in Boho last year.
At Enniskillen Magistrates Court on Monday, the court heard Brian Duffy (51), of Rigg Road, Enniskillen, was stopped by police on the Samsonagh Road, Boho on January 11 at around 1am.
Officers observed Duffy to be unsteady on his feet, smelt of alcohol and his eyes were glazed.
Duffy failed a preliminary breath test and an evidential reading came back with 48mg of alcohol in 100ml of breath, 13mg over the limit.
A blood sample was also taken and this returned a reading of not less than 115mg of blood in 100mm of blood.
Michael Fahy, representing Duffy, said the loss of his licence would have an “immeasurable” impact on his family.
He said there was nothing aggravating about his client’s driving on the night in question; he had just been stopped and added there was no divergence between the breath and blood samples.
He asked the court to reflect in its sentencing Duffy’s lack of previous record, and the effects the loss will have on him.
District Judge Steven Keown disqualified the defendant for 12 months, fined him £300 and certified him for the drink drivers’ course.
