A man who was found asleep in his car by police was on his way home after having drinks in Bundoran.
At around 5am on May 2, 2022 police came across a Ford Mondeo on the Lattone Road, Garrison, in which the driver was asleep in.
There was no one else in the car and officers detected a smell of intoxicating liquor and Patrick McLaughlin (57) had his seatbelt on and the engine was running.
Officers turned the engine off and McLaughlin failed a preliminary breath test before being arrested.
McLaughlin was taken to Omagh Police Station where he gave an evidential breath sample of 47mg of alcohol in 100ml of breath.
During interview, McLaughlin gave a "full and frank admission" saying he had been coming from Bundoran and felt tired so he pulled over to sleep.
His solicitor, Gary Black asked the court to give McLaughlin maximum credit for his admission during interview that he was driving as the charge would have been in charge with excess alcohol instead of driving with excess alcohol.
Mr. Black said McLaughlin had been socialising in Bundoran and felt fit and able to drive home but reassessed his position and pulled into sleep until the morning.
District Judge Steven Keown handed McLaughlin a 12 month driving disqualification and £200 fine for driving with excess alcohol in his breath.
