A man who was given a probation order following his conviction for supplying Class A drugs and being in possession of a Class B drug with intent to supply has had his order revoked as he failed to comply with the requirements of the order.
At Enniskillen Magistrates Court on Monday, District Judge Steven Keown had no hesitation in re-sentencing after being told by probation that they did not believe the order would be completed.
It was heard that originally a combination order was issued to Conor McManus (26), with an address of Drumbawn Close, Drumclay, Enniskillen, but it was later changed to a probation order.
Myles McManus, representing McManus, told the court the result of the original case had a significant impact on his mental health, he lost his job and was living as a “hermit”.
He did ask for one further opportunity for the defendant to comply with the order but this was dismissed by Judge Keown.
Judge Keown said the offences were serious in which McManus supplied drugs to a 14 year old.
He said the alternative to a custodial sentence for McManus was a combination order and then probation to address the issues but McManus had completely failed to co-operate with probation.
Judge Keown said the only way the case can be dealt with is by custodial sentence and he handed down a three month prison sentence to McManus.
After a discussion with his solicitor following the ruling, McManus was released on bail pending appeal.
