A judge has described a man who sexually assaulted a woman in her home as someone who behaved disgracefully and continues to do so.

Enniskillen Magistrates Court on Monday was told how police received a report on May 31, 2021, from the injured party that she had been sexually assaulted.

She told police how Martin Connolly (71), of Galloon Gardens, Newtownbutler has grabbed her vagina and bottom.

Connolly was interviewed on June 1, 2021, and admitted to being in the victim’s house but denied touching her.

In a further statement, he said he had gone over to see a male because he had no car and was going to take the injured party’s children to look at animals.

He said he walked through the gate and knocked on the door before entering the house and shouting out the names of the occupants.

The court heard the injured party told Connolly her partner was away with their daughter.

When asked what happened next, Connolly said he could not remember and that he did not touch the injured party.

Connolly also made derogatory remarks about the victim and said: “I never touched a woman in that area in my life.”

He also said there was also previous history between himself and the injured party’s father.

In his submissions, Connolly’s barrister, Stephen Mooney said he was in a difficult position due to the pre-sentence report for the defendant.

But he asked the court to look at the sentencing guidelines for the sexual assault and submitted that what happened was in the middle category for sentencing.

He said that while there were aggravating factors such as it happening in the injured party’s house, it did not put it in the “highest stratosphere” for sentencing.

District Judge Steven Keown handed Connolly a five-month prison sentence for the sexual assault saying it was a “disgraceful incident” and Connolly continued to behave in a disgraceful manner.
