A man who breached a restraining order by contacting his ex-partner has received a six-month prison sentence.
On July 8, 2022, at around 7pm police received a report from the injured party that her ex-partner had been pestering her all afternoon despite there being a restraining order in place until June 2024.
Police found the ex-partner, Nerijus Jasiunas (43), with an address of Willoughby Place, Enniskillen asleep under a tree a short distance from the injured party's house/
She stated that the defendant had been outside her property for the previous six hours shouting to get her attention.
Jasiunas was arrested and the next day, July 9 the injured party gave a statement the defendant had arrived at the property and was banging on the door and saying he had changed and wanted to talk to her.
The defendant had a bottle of whiskey which he drank from while continuing to shout. he also phoned and messaged the injured party numerous times from July 6 to July 8 before arriving at her flat.
The injured party said she had received messages from three different accounts from Jasiunas saying he was coming to Enniskillen and was going to see the injured party.
When interviewed, Jasiunas said he had come to Enniskillen to meet a friend and bought a bottle of whiskey which he drank at a public park before two "alcoholic women" started shouting at him, which he said he ignored.
Stephen Fitzpatrick, Jasiunas' barrister, told the court his client had entered a guilty plea at a very early stage.
He said these were "serious charges" and that the defendant accepts guilt and there was no excuse for his behaviour.
Mr. Fitzpatrick said a mixture of alcohol and a "misguided and misplaced" attempt to revive the relationship was the catalyst for this incident and he hoped the penny had dropped for Jasiunas that the relationship was over.
In convicting Jasiunas of breaching a restraining order and a domestic abuse offence, District Judge Steven Keown said the courts take domestic abuse "extremely seriously" which was reflected in the fact there was new legislation passed that the courts would not hesitate to use.
In total Jasiunas was sentenced to six-month custody.
