A man stopped by police on an Enniskillen road was over twice the legal drink drive limit.
It was heard at Enniskillen Magistrates Court on Monday how on August 14, at around 7.20pm, police observed a Volkswagen car on the Cornagrade Road in the town which had moved over the centre of the road and quickly steered back into its own lane.
Officers stopped the car and spoke to the driver, Arturs Petrusevics (36), of College Park Lane, Enniskillen.
When asked to provide a sample for a preliminary breath test, he refused and was arrested.
He then gave an evidential reading of 89mg of alcohol in 100ml of breath.
His solicitor, Garry Smyth, said there was confusion on Petrusevics' part on his obligations to provide a specimen for a preliminary breath test, and he had co-operated fully with the evidential sample.
Referring to the incident, Mr. Smyth said his client had exercised poor judgement in leaving his daughter's shoes over to her mother's house when he was caught.
He asked for credit for the defendant's clear record and early plea.
For driving whilst unfit, and failing to provide the specimen of breath, Petrusevics was banned from driving for 14 months, and fined a total of £300.
