A man found asleep in a car in Kesh had no driving licence or insurance in place.
At around 1.40am on July 18, 2022 police were on mobile patrol on the Pettigo Road, Kesh when they observed a Mercedes C-Class parked up.
The driver of the car, John O'Donnell (51), with an address of Trienamongan Road, Castlederg appeared to be sleeping. Checks on the car showed no insurance policy in place.
When he was asked to produce his insurance documents O'Donnell told police he has just drove from work and did not have any insurance.
A Fixed Penalty Notice was issued and O'Donnell was ordered to produce his driving licence but following multiple failed attempts to contact him.
O'Donnell's solicitor Gary Black told Enniskillen Magistrates Court his client had been living in Monaghan but was working as a chef in Donegal and had pulled into have a sleep due to tiredness.
He said the defendant made a full admission at the roadside and that he had a provisional driving licence in the Republic of Ireland.
Mr. Black also said insurance was taken out on the car the following day but O'Donnell no longer owned it.
He also asked the court to give O'Donnell credit for his co-operation.
For having no insurance and no driving licence O'Donnell was banned from driving for two months and fined £400.
