A court has heard how a man who resisted police acted out of “frustration” after it was reported he had been drink driving.

On July 12, 2022, police attended an incident in the Drumahoe Gardens area of Enniskillen in which it was reported a man appearing under the influence of drink or drugs had driven away from a property.

Police attended the address of the man, Nicholas Fee (40), of Lisgoole Park, Enniskillen and observed a car parked outside the address.

There was a smell of alcohol, his speech was slurred and police observed Fee drinking cans of alcohol in his living room.

He was physically resistant and was arrested for driving while unfit.

He refused to give a preliminary breath test but did provide a specimen in custody.

He told police he was unaware he was required to provide a specimen.

Steffan Rafferty, a barrister for Fee, explained to the court that this case was due for a contest but with issues sorted out the case had been resolved.

Fee had been facing a charge of driving with excess alcohol but this was withdrawn and he entered guilty pleas to resisting police and failing to provide a specimen.

Mr. Rafferty said police landed at Fee’s home to arrest him and what he did was ultimately borne out of frustration as he did not know why they had come to his door. He added Fee was apologetic and regretful for his actions.

Fee was handed four penalty points and fined a total of £350 for resisting police and failing to provide a specimen.
